What is a Fiduciary

A Licensed Fiduciary is a certified professional, regulated by the state's Supreme Court, who is legally appointed for a fee to manage the personal, medical, and financial affairs of vulnerable or incapacitated adults. They are essentially a professional stand-in for decision-making.

There are a few things fiduciaries can specialize in: financial investors, guardianship, conservatorships, and estate administrators, Here at Voyage Fiduciary we specialize in Guardianship and Conservatorship

Guardianship Services

Definition: In Arizona, a Guardian is appointed by the Superior Court to make personal, medical, and residential decisions for an individual, who is legally determined to be incapacitated.

Our Guardianship care looks like:

Person-Centered Decisions: Operating on substituted judgment (preferences of the Ward) over the "best interest" standard wherever possible, ensuring their needs and interests are central.

Holistic Well-being: Ensuring appropriate medical care and leveraging our belief that human connection is vital for health by actively facilitating family visits, social outings, and community interaction.

Community Integration: Determining living arrangements in the least restrictive environment and including their existing support system (family, friends, and caretakers) in all decisions.

Collaborative Planning: Maintaining open, regular communication with all parties, reflecting our core belief that collaborative planning with existing support structures is essential.

Ethical Oversight: Committing to meticulous record-keeping and court reporting, and upholding our commitment to transparent and ethical business practices.

Conservatorship Services

Definition: In Arizona, a Conservator is appointed by the Superior Court to manage the financial estate and property of an individual, who is legally determined to be unable to manage their own financial affairs.

Our Conservator care looks like:

Asset Management for Life: Managing all income, assets, and property to ensure financial resources are primarily directed toward supporting the goals of the care plan and the lifestyle the Protected Person desires.

Prudent Financial Expertise: Managing budgets, investments, and tax filings with meticulous care, operating at the highest level of fiduciary responsibility to preserve and grow the estate.

Transparency & Efficiency: Filing comprehensive financial reports and accountings with the Court, upholding our standard for transparent and ethical business practices. Our ability to navigate red tape ensures that all benefits and entitlements are secured efficiently.

Vigilant Protection: Protecting the estate from fraud, exploitation, and dissipation, ensuring every financial decision is made solely for the benefit of the Protected Person.

Care Alignment: Maintaining close coordination with professional partners to ensure financial resources align perfectly with the Ward's medical, residential, and social needs.

The Ready to Launch Program is your essential back-up system for unforeseen events. We create and maintain a comprehensive, 'living profile' of care for the individual. This service is designed for family Guardians or Conservators who need a swift, organized solution if they become unexpectedly unable to provide care. It works along side existing estate plans to ensure that up-to-date client information and care coordination are instantly accessible, allowing Voyage Fiduciary to step in quickly, minimize disruption, and reduce stress during an unexpected transition.

Enrollment is prepaid for one year and is renewable annually.

Excluded Services

A part of our commitment to specialized and transparent care is defining what services are not a good fit and clearly disclosing these upfront.

We are actively working to build a robust network of community referrals that specialize in these areas.

Document Preparation

We do not prepare or review documents for existing or applying guardians and conservators. This would be a breach of our license as it requires a Legal Document Preparer License or Attorney Licence

Guardian or Conservator due to Addiction or a Mental Health Crisis

Informed care is very important, and we do not have the expertise required for these specific types of cases. Our expertise is focused on individuals who need care due to age, illness, or developmental disability.

Legal Advice or Counsel

Legal advice and counsel is a privilege of a licensed Attorney. We specialize on the fiduciary work we do, not on providing legal options and recommendations, or representation in a court of law.

Representative Payee (As a Stand-Alone Service)

Representative Payee services are often a part of Guardianship or Conservatorship services as a Representative Payee is the assigned manager of an individuals Social Security funds. But we do not do stand-alone Representative Payee Services as our rates are too high for sustainable and ethical management of funds.
